1. Applicability 

1. These terms and conditions apply to every order placed with Fruitslagers Shop.
2. By placing an order, the customer agrees to these terms and conditions. 

2. Offer and prices 

1. The offer on the Fruitslagers shop contains the most complete and accurate description possible of the products, ingredients and their origin.
2. The prices shown are inclusive of VAT and exclusive of shipping costs, unless otherwise stated.
3. Fruitslagers BV reserves the right to adjust prices. 

3. Agreement 

1. The agreement is concluded when the customer places the order and payment is completed.
2. Fruitslagers BV may refuse an order in the event of errors in the offer or suspected fraud. 

4. Payment 

1. Payment is made via the Fruitslagers shop offered payment methods.

2. By paying via SEPA direct debit, the customer gives permission to Fruitslagers BV to send recurring direct debit instructions to his or her bank to debit amounts from the account in accordance with the agreement. The customer also authorizes his or her bank to carry out these direct debits in accordance with the instruction of Fruitslagers to execute BV.

   The customer has the right to have a debit reversed via their own bank within 8 weeks of the collection date without giving a reason.

3. Orders will only be shipped after payment has been received. 

5. Delivery 

1. Delivery will take place at the address specified by the customer.
2. Delivery times stated are indicative. Fruitslagers BV ships orders on Tuesdays and Thursdays, excluding holidays. Delivery times then depend on the shipping partner.
3. The risk of damage or loss lies with Fruitslagers BV until the moment of delivery to the customer.
4. The customer is responsible for collecting the delivery on time from parcel points. 

6. Subscriptions

1. For certain products, it offers Fruitslagers BV takes out a subscription.

2. By taking out a subscription, the customer agrees to periodic payment via direct debit.

3. The subscription has an initial term of 3 months and is then automatically continued indefinitely.

4. Payment is made quarterly in advance via direct debit.

5. The customer can cancel the subscription at any time after the first 3 months, before the next direct debit date.

6. The cancellation takes effect at the end of the current payment period.

7. Right of withdrawal (Return) 

1. The customer has a 14-day reflection period from receipt of the products.
2. The right of withdrawal does not apply to sealed food or beverage products after opening. Returned products must be clean, dry, and unopened.
3. Return costs are the responsibility of the customer, unless otherwise agreed.
4. In case of a valid return you will pay Fruitslagers BV back within 14 days.
5. In case of revocation, the customer can use the sample letter right of withdrawal. 

8. Conformity and warranty 

1. Fruitslagers shop guarantees that products comply with the agreement and legal requirements. 
2. In case of a defective or incorrect product, the customer must contact us within 7 days of delivery. 

9. Complaints 

1. Complaints can be reported via order@fruitslagers. Nl.
2. Complaints must be reported within 7 days of receiving the order.
3. Fruitslagers BV will respond within 14 days of receiving the complaint. 

10. Force Majeure 

1. Fruitslagers BV is not liable for delays or shortcomings due to circumstances beyond its control, such as strikes, disruptions or transport problems. 

11. Liability 

1. Liability is limited to the amount of the order.
2. Fruitslagers BV is not liable for indirect damage. If a package is damaged during transport, Fruitslagers BV works together with the customer to find a suitable solution. 

12. Privacy 

1. Fruitslagers BV processes personal data in accordance with the privacy policy and the GDPR. 

13. Governing Law 

1. Dutch law applies to these conditions.
2. Disputes will be submitted to the competent court in the Netherlands.
